audigo 30-Day Money Back Return Policy

You may return your Audigo wireless microphone and cancel your subscription for any reason within thirty (30) days of the date of its shipment to you and receive a full refund of the purchase price and any sales tax. In order to return your Audigo wireless microphone, the following conditions must be met:

  1. Request a return by emailing info@audigolabs.com within 30 days of its shipment to you

  2. Return the microphone, including all parts, the mount, the charging cable, and quick start guide in the original packaging, in good physical condition (not damaged or broken, or as received in the case of a defective product) within 7 days of receiving your return label.

Additional Terms and Conditions

  • If your return fails to meet any of the above conditions, we may, at our discretion, refuse to accept it. Audigo may require that you furnish proof of purchase details in order to obtain a return label.

  • Once your return is received and passes inspection, your refund will be processed and a credit will be applied to your original form of payment. Refunds will be processed and paid within 1 week of Audigo’s receipt of the microphone. Please note that, depending on your credit card company or bank, it may take an additional 2 to 10 business days after your credit is approved for it to post to your account.

What products are covered by this Limited Warranty?

This limited warranty covers all Audigo products, including but not limited to our microphones, mobile apps, and cloud services, and accessories..

What types of problems does the Limited Warranty cover?

From the date of purchase in the U.S., Audigo Labs, Inc. (“Audigo”) provides a non-transferable Limited Product Warranty (“Limited Warranty”) against defects found in materials or workmanship of our microphones, mobile apps, and cloud services, and accessories (the “Product”) when used under normal, non-commercial use, in accordance with care instructions.

Who is covered by the Limited Warranty?

This Limited Warranty covers the original retail consumer purchaser of the Product, or a consumer who receives the Product new and unused as a gift from the original retail purchaser. Coverage terminates if a covered consumer sells or otherwise transfers the Product. This warranty is provided only to the original consumer purchasing the product, and all express and implied warranties to non-consumers are disclaimed.

What is the period of coverage for the Limited Warranty?

This Limited Warranty begins on the date of purchase and lasts one year.

What is required to demonstrate that my product is within the Limited Warranty?

Proof of the valid Product purchase is required to obtain coverage under this Limited Warranty (“Proof of Purchase”). Proof of Purchase is an original or copy of the sales receipt for the Product purchased, or the Product purchase invoice. This Proof of Purchase must show the Product model number, payment, and the date of the Product purchase. Product registration, while appreciated and useful for customer service purposes, is not required to activate any Limited Warranty and the Product registration is not a substitute for a Proof of Purchase.

What limitations apply to the Limited Warranty?

The following will invalidate your Audigo Limited Warranty:

  • The use of accessories that are not Audigo-made or -authorized. 

  • The use of non-Audigo/non-Audigo-authorized replacement parts.

  • Repair or maintenance of the Products other than by Audigo or parties authorized by Audigo.

 

This Limited Warranty excludes coverage for:

  • Damage that occurs from misuse or abuse.

  • Damage caused by failure to follow use and care instructions.

  • Minor imperfections and slight color variations, which are normal.

  • Damage or defect to plastic components.

  • Normal wear and tear.

Audigo will not be responsible for any indirect, incidental, special, punitive, or consequential damages related to the Audigo Product. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you. This warranty gives you specific legal rights, and you may also have other rights which vary from state to state.

What will Audigo do if my Product needs warranty coverage?

Should your Audigo Product require warranty service, please contact our Audigo Support at info@audigolabs.com to file a warranty claim. Upon approval of your claim, Audigo will repair or replace the item without charge. If the replacement product is no longer in production, one of equal or greater retail value at the time of purchase will be given.

AUDIGO ONE-YEAR LIMITED WARRANTY

INTRODUCTION TO THE WARRANTY

“Audigo” as used herein, shall mean Audigo Labs, Inc.

“Jurisdiction” shall mean either:

(i) The jurisdiction of original purchase of the Product for which Warranty coverage or service is being sought, which is within the fifty states of the United States and the District of Columbia only; or

(ii) The jurisdiction from which Warranty coverage or service is being sought, which is within the fifty United States and the District of Columbia only, and only if the jurisdiction of original purchase was also within the fifty states of the United States and the District of Columbia only.

Warranty coverage and service is not available outside covered Jurisdictions. Excluded areas include any other US territories, commonwealths, possessions, or protectorates, all provinces or territories of Canada, and the rest of the world.

TERMS OF LIMITED WARRANTY COVERAGE

What types of problems does the Warranty cover?
Audigo provides a One-Year Limited Warranty (the “Warranty”) against defects in product materials or workmanship on Audigo Products. This Warranty is offered on only those Audigo brand products (each, a “Product”) purchased and used in a covered Jurisdiction by a consumer and is the sole and exclusive Warranty provided by Audigo for Products.

What is the period of coverage for the Warranty?
The Limited Warranty period lasts 1 year from the date of purchase of the Product from Audigo or one of Audigo’s authorized retail partners. The Warranty starts on the date of Product’s purchase by a customer in a covered Jurisdiction and ceases on the 1 year anniversary date of such Product purchase (“Warranty Period”).

Who can claim Warranty coverage?
The original purchaser of the Product can claim Warranty coverage during the Warranty Period. If the original purchaser sells, gives, or transfers the Product to another non-commercial user, that non-commercial user can claim Warranty coverage during the Warranty Period. Sale and transfer shall not extend the Warranty Period.

What will Audigo do to correct problems under the Warranty?
During the Warranty Period, Audigo may:

  • Repair the Product with new or refurbished parts;

  • Replace the Product entirely, either with a new or refurbished Product at no additional charge to the consumer;

  • Replace defective parts of the Product with those that meet the performance specifications of new parts for any applicable Product; or

  • Reimburse the customer for any defective Product or parts.

All exchanged or substituted parts and Products replaced under Warranty service will become the property of Audigo. Repaired or repaired Products or parts thereof will be warranted by Audigo for the Warranty Period. If after three attempts to repair or replace during the warranty period the Product is still defective, you can elect to receive a replacement or a full refund of your purchase price.

What happens if I use a non-Audigo/non–Audigo-authorized part or accessory with my Audigo Product?
Use only Audigo or Audigo-authorized accessories and replacement parts. The use of accessories that are not Audigo-made or -authorized voids this Warranty. Additionally, the use of non-Audigo/non-Audigo-authorized replacement parts voids this Warranty.

What other limitations apply to the Warranty?
Audigo’s obligation to the consumer under the Warranty for any Product is limited to the repair, replacement, reimbursement, or refund for any defective Product or parts pursuant to the terms and conditions of the Warranty. This Warranty is only valid for Products purchased and used in the Jurisdiction described herein and shall not extend to any Products (a) not purchased in the 50 states of the United States or the District of Columbia or (b) purchased in the 50 states of the United States or the District of Columbia, but which are used or transferred outside any covered Jurisdiction.

This Warranty covers defects and product materials and workmanship. It does not cover ordinary maintenance or replacement due to normal wear and tear, corrosion, rust, stain, or age of the Product. Cosmetic damages are not covered (examples include, but are not limited to scratches, imprint/water marks, cracks, dents, stains, etc.).

This Warranty expressly excludes any defects or damages caused by accessories, replacement parts or repair service other than those that have been authorized by Audigo pursuant to the terms hereof.

No other warranties, express or implied, are made by Audigo or are authorized to be made on behalf of Audigo to any consumer or other party by any retailer, agent, distributor, or other party with respect to any Product.

What will void the Warranty?
The Warranty is voided for a Product should any of the following occur, without limitation:

  • Products damaged due to any use contrary to Audigo’s warnings and instructions, mishandling, negligence, excessive wear and tear, including damages caused by maintaining, operating, or using the Product in a manner not consistent with, in accordance, with, or not contemplated by the instruction manual provided by Audigo with the Product, or by otherwise failing to follow safety, operating, care or cleaning instructions;

  • Products where the Product number model or serial number has been removed, replaced, altered, or rendered illegible;

  • Products which have been altered, modified, or repaired in any way not expressly authorized in the instruction book provided by Audigo with the Product or by any party not authorized by Audigo as an Authorized Servicer;

  • Failures on Products attributable to non-manufacturer defects such as mishandling during transportation after purchase, drops, spills, and extreme temperature;

  • Products that have been damaged directly or indirectly from the use of a third-party product;

  • Products damaged as a result of acts of nature (for example, fire, flood, lightning, power outages);

  • Products damaged as a result of connection to irregular current or voltage sources or use on electric or other current or voltage other than that marked on the Product or any instruction book;

  • Products returned by the consumer to Audigo, not using a Audigo provided shipping label, which are lost, misdelivered, or damaged in transit; or

  • Products for which reimbursement or refund has been provided as a final remedy to a Warranty claim.

WARRANTY DISCLAIMERS; LIMITATIONS OF REMEDIES; ACKNOWLEDGEMENTS
CONSUMER’S SOLE AND EXCLUSIVE REMEDY UNDER THIS LIMITED ONE YEAR WARRANTY SHALL BE AS PROVIDED BY THE PROVISIONS, TERMS, AND CONDITIONS HEREIN.

NEITHER AUDIGO NOR ITS PARENT OR OTHER HOLDING COMPANIES, SUBSIDIARIES, AFFILIATES, AUTHORIZED DISTRIBUTORS, RETAILERS, OR AUTHORIZED SERVICE PROVIDERS, OR ANY OFFICERS, DIRECTORS, AGENTS, OR EMPLOYEES THEREOF, SHALL BE LIABLE FOR ANY INCIDENTAL OR CONSEQUENTIAL LOSSES OR DAMAGES (INCLUDING WITHOUT LIMITATION, DAMAGES OR LOSSES FROM TRAVEL, LOST TIME, DAMAGES FOR LOSS OF REVENUE, BUSINESS PROFITS, GOODWILL OR CONTRACTS, BUSINESS INTERRUPTION, OR ANY OTHER PECUNIARY LOSS, COMPENSATION RESULTING FROM SUCH LOSS), OR ANY OTHER LOSS OR DAMAGES ARISING OUT OF ANY MALFUNCTION OF ANY PRODUCT OR OTHER DAMAGES RESULTING FROM THE USE OF PRODUCT, WHETHER IN CONTRACT, TORT, OR OTHERWISE. AUDIGO DOES NOT LIMIT THE DURATION OF ANY IMPLIED WARRANTIES. NOTE: SOME JURISDICTIONS, INCLUDING NEW JERSEY, DO NOT ALLOW THE EXCLUSION OR LIMITATION FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE FOREGOING DISCLAIMER MAY NOT APPLY TO A CONSUMER RESIDING IN THOSE PARTICULAR JURISDICTIONS.

IT IS UNDERSTOOD AND AGREED BY THE CONSUMER UPON PURCHASE OF A PRODUCT THAT, EXCEPT AS EXPRESSLY STATED HEREIN, AUDIGO IS NOT MAKING OR HAS NOT AT ANY TIME MADE ANY EXPRESS WARRANTIES OR REPRESENTATIONS OF ANY KIND OR CHARACTER, WITH RESPECT TO THE PRODUCT.

THE CONSUMER ACKNOWLEDGES THAT THE CONSUMER IS INFORMED AND IS AWARE OF HIS/HER RIGHTS AND OBLIGATIONS UNDER ANY APPLICABLE LOCAL MUNICIPAL AND JURISDICTION LAWS GOVERNING THE PURCHASE AND USE OF THE PRODUCT. THROUGH THIS LIMITED WARRANTY, AUDIGO PROVIDES LIMITED AND SPECIFIC RIGHTS TO THE CONSUMER IN CONNECTION WITH THE PRODUCT. CONSUMERS MAY ALSO HAVE OTHER APPLICABLE RIGHTS WITH REGARD TO THE PRODUCT AND WARRANTY WHICH VARY FROM JURISDICTION TO JURISDICTION AND WHICH ARE NOT OTHERWISE SET FORTH HEREIN.

IF ANY PROVISIONS OF THIS WARRANTY ARE JUDGED TO BE ILLEGAL, INVALID, OR UNENFORCEABLE, THE REMAINING PROVISIONS OF THE WARRANTY SHALL CONTINUE IN FULL FORCE AND EFFECT.

How do I submit a Warranty claim?
If a Product or one of its parts qualifies for replacement or service under the Warranty, contact Audigo Support. Audigo will either provide further instructions on the Warranty claim process (including, but not limited to qualification under the Jurisdiction provisions of this Warranty) or otherwise address any steps to repair or replace the Product or part. If you purchased a Product from a Audigo-authorized retailer, Audigo may request a receipt or shipment confirmation to confirm the date of purchase and the beginning of the Warranty Period.

If the Product needs repair, replacement, or reimbursement under the Warranty, Audigo will send a pre-paid shipping label via email so that the Product may be sent to Audigo at no cost to the consumer. At Audigo’s option, if you provide a payment card number, Audigo may ship you a new or refurbished Product upon receipt of your claim and place a hold on your payment card for the cost of the replacement Product. Audigo will release the hold upon receipt of your old Product. Typical response time to address Warranty claims is 10 to 14 business days, plus shipping, depending on the geographical location of the consumer and the type of damage or the nature of such Warranty claim.

For additional protection of the Product and to ensure secure handling while a Product is being returned for any Warranty repair, Audigo recommends that consumers employ Audigo’s shipping label or a traceable, insured delivery service. Audigo is not responsible for any damage while a Product is in transit or for Products shipped by the consumer that are not received by Audigo or a designated Audigo Authorized Servicer.

WARRANTY NOTICE TO CALIFORNIA RESIDENTS ONLY
California residents may initiate Warranty service by emailing us at info@audigolabs.com or visiting Audigo Support at www.AudigoLabs.com. California law also provides that for any Warranty service for a Product, California residents have the option of returning the Product (a) to the retailer from which it was originally purchased, or (b) to another retailer that sells the same Audigo Product, among other rights and consumer protections. California residents need only contact Audigo Support for specific instructions on obtaining Warranty service. Audigo will only be responsible for the cost of repair, replacement or reimbursement and shipping and handling for such Products under its Warranty. A retail store to which a California resident returns a Product for Warranty service may refer the consumer to a Audigo Authorized Servicer, replace the Product, or refund the Purchase price less the amount directly attributable to the consumer’s usage of the Product. If the above options do not result in the appropriate remedy to the consumer, the consumer may then take the Product to an independent repair facility if service or repair can be economically accomplished. Audigo and not the consumer, will be responsible for the reasonable cost of such service, repair, replacement, or Reimbursement during the Warranty Period of the Product if such Product is subject to the Audigo Warranty.
